Legal basis for processing

Jobecam processes personal data based on the legal grounds set out in Brazilian Law No. 13,709/2018 (General Data Protection Law – LGPD), in particular:

  • Consent of the data subject (art. 7, I), for sending marketing communications and the use of non-essential cookies;
  • Performance of a contract or preliminary procedures (art. 7, V), to provide the selection and recruitment services;
  • Compliance with a legal or regulatory obligation (art. 7, II), to retain records required by law;
  • Legitimate interest (art. 7, IX), for information security, fraud prevention and service improvement, always respecting the rights and freedoms of the data subject.

Where sensitive data is processed (for example, diversity data provided voluntarily), processing is carried out based on the specific and highlighted consent of the data subject (art. 11, I) or another applicable legal basis.

Data sharing and disclosure

Jobecam does not sell, rent or trade personal data. Sharing only occurs in the situations below and is always limited to what is necessary for the stated purpose:

  • Hiring companies (recruiters): candidate data and videos are made available to the companies responsible for the respective selection processes, exclusively for evaluation purposes.
  • Processors and service providers: suppliers that process data on behalf of and under the instructions of Jobecam, such as cloud infrastructure providers (hosting and storage), email delivery services, traffic analytics tools and artificial intelligence transcription and processing services. All processors are contractually required to adopt security measures and to process data only in accordance with the purposes described here.
  • Public authorities and legal compliance: when there is a legal or regulatory obligation, or an order from a competent authority.
  • Corporate transactions: in the event of a merger, acquisition or corporate reorganization, while maintaining data protection obligations.

Data retention and disposal

Personal data is kept only for the period necessary to fulfill the purposes for which it was collected, or for the period required by legal and regulatory obligations. Once the retention period or the purpose ends, data is securely deleted or anonymized.

The main retention periods are:

  • Account registration data: while the account is active and for up to [12 months] after the end of the contractual relationship.
  • Resumes, videos and candidate data: for the duration of the selection process and for up to 5 years after its conclusion, unless the data subject consents to retention in a talent pool.
  • Sharing links: expire automatically within 5 (five) days.
  • Browsing data and cookies: until the end of the session.
  • Access records and logs: for the applicable legal period (as a rule, 6 months, under the Brazilian Civil Rights Framework for the Internet).
  • Data retained due to a legal obligation (tax/accounting): for the periods required by current legislation (as a rule, up to 5 years).

Deletion may not occur when the retention of data is necessary to comply with a legal or regulatory obligation, for the regular exercise of rights in proceedings, or through anonymization, in which case the data ceases to be personal data.

Data subject rights

Under article 18 of the LGPD, the data subject may, at any time and upon request, exercise the following rights:

  • Confirmation of the existence of processing;
  • Access to the data;
  • Correction of incomplete, inaccurate or outdated data;
  • Anonymization, blocking or deletion of unnecessary or excessive data, or data processed in non-compliance with the law;
  • Portability of data to another service or product provider;
  • Deletion of data processed based on consent;
  • Information about the public and private entities with which Jobecam has shared data;
  • Information about the possibility of not providing consent and the consequences of refusal;
  • Withdrawal of consent, at any time.

In addition, given that Jobecam uses artificial intelligence technologies in part of its services, the data subject has the right to request a review of decisions made solely on the basis of automated processing that affect their interests, under article 20 of the LGPD.

How to exercise your rights

Requests can be sent to the Data Protection Officer (DPO) at dpo@jobecam.com. We will respond to requests as soon as possible, within the legal deadlines. If you believe your rights have not been met, you may file a complaint with the Brazilian National Data Protection Authority (ANPD).
